What personal data we collect

This Privacy Policy covers the ways in which Emenda Holding Company Limited and its subsidiaries and franchises (“Emenda”) collects and manages your personal data, in accordance with General Data Protection Regulation (GDPR) rules.

In this policy, “personal information” or “personal data” means information about an identifiable individual that is subject to protection under the law in the jurisdiction in which you reside.

We may collect personal data from individuals and organisations that:

  • browse any Emenda owned websites and domains, including com as well as regional or country-specific sites (collectively, “Emenda Websites”)
  • purchase products or services from us
  • sign up to our mailing list
  • interact with us via phone, email, fax, social media or in person

Emenda may amend this Privacy Policy at any time by posting the amended terms on this site. All amended terms automatically take effect on the date set out in the posted Privacy Policy, unless otherwise specified.

Reasons for data collection

There are several reasons why we may legally collect and process personal data. These include:

  • Consent: This covers all instances whereby you give your consent for data to be collected. For example, this may occur if you tick a box to indicate that you would like to receive an email newsletter. If we are processing your personal data based on your consent to marketing, you may withdraw that consent at any time by informing us directly or unsubscribing from our mailing list, for example using the unsubscribe link in our marketing emails.
  • Contractual obligations: This includes situations where we are obliged to collect personal data to carry out contractual obligations, such as fulfilment of an order or contract.
  • Legal compliance: In rare situations we are obliged to collect data for legal reasons. An example of this is if we are subject to fraudulent activity, then data may need to be provided to the appropriate legal authority or law enforcement body.
  • Legitimate interest: This includes all situations whereby we collect data that is reasonably required for the running of our business.

Types of information we collect and use

We primarily use your information to ensure the best possible experience as a customer or prospective customer when using our website or interacting with us by phone, email or in person. This type of data collection and usage is covered by data privacy laws as a ‘legitimate interest’ as understanding our customers or perspective customers is vital to us operating a successful business.

In most cases, you provide us with your consent to use your personal data in accordance with this policy by providing us with that information. In some cases, we may specifically ask for your express consent if we believe that the information is sensitive, or our use of the information may include other uses not covered by this Privacy Policy or another privacy notice to which we have made available to you.

The Emenda Websites may automatically collect technical information about your visit (such as browser type, Internet service provider, platform type, internet protocol (IP) addresses, referring/exit pages, operating system, date/time stamp). We do not associate this information with other information about you. We aggregate this information for reporting about the Emenda Websites to analyze trends, diagnose problems with our server and administer the Emenda Website, to track user movement and use, and to gather broad demographic information.

We do not control those sites or their privacy practices, which may differ from our own privacy practices. This Privacy Policy does not cover any personal data that you choose to give to unrelated third parties. We do not monitor or control the information collected by such sites or the privacy practices of any third parties, and we are not responsible for their practices or the content of their sites.

In addition, we may, subject to applicable law, voluntarily provide information in order to assist in a law enforcement investigation or where the disclosure is necessary to protect our systems, our business or the rights of others.
